The aim of this article is to examine, within the framework of constitutional law scholarship, the criticisms directed at the 1997 Constitution of the Republic of Poland concerning its allegedly post-communist or even communist character. The first part analyzes the provisions of the 1952 Constitution of the Polish People’s Republic relating to the principles of the political system and the organization of public authority, in order to identify the main features of the only communist constitution in the Polish constitutional tradition. The second part compares the fundamental principles of the political system established under the Constitution of the Polish People’s Republic with those defined by the 1997 Constitution of the Republic of Poland. The third part provides an analysis of the current constitutional regulations governing the structure of public authorities and identifies their references to the Polish constitutional tradition. The final part summarizes and presents the results of the research undertaken in the article.
