The cooperation of state courts of different Member States is regulated at the EU level. One of the legal acts dealing with this matter is Regulation (EU) 2020/1783 of the European Parliament and of the Council on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters. Although it does not apply directly to arbitration courts, in some cases its provisions will affect the evidence proceedings that will be pending before the arbitral tribunal. At the request of the arbitration court, the state court will be entitled to take evidence, including in relation to cross-border issues, when it becomes necessary to apply for legal aid to a state court of another Member State, which may be granted on the basis of the regulations contained in the Regulation No 2020/1783.
