Electronic Writ Proceeding – A Few Observations, Practical Operation

Abstract

The author focuses on electronic writ proceeding, which is type of writ proceeding regulated in polish legal system. The article is divided into four parts. The first part describes the general comments on electronic writ proceeding. The author gives significant information about the facultative nature of electronic writ proceeding. The author in the second part analyses the basic assumptions of the functioning of the electronic court and electronic writ proceeding. The claim is made in electronic form filling in on-line. There is e-court as a civil division of the District Court in Lublin which deals with these cases. The plaintiff is required to communicate with the e-court only electronically. The third part describes an outline of the system's functions. Electronic system enables a potential plaintiff to sue somebody. Plaintiff is identified in Electronic Writ Proceeding after creating an individual account. Finally, the author presents e-court in statistics. The most important advantages of electronic writ proceeding are: lo w costs, electronic form of all plaintiff’s documentary or electronic enforcement.
