
The article contains three parts. The first part reveals the factual course of the Callisien case, which is the subject of the sentence of the Roman Rota coram Vito A. Todisco of 13 October 2016 declaring the nullity of a marriage on the grounds of reverential fear. The second part explains the grounds for the nullity of a marriage on the grounds of force and fear in the light of the provisions of Canon 1103 of the 1983 Code of Canon Law and the basic legal concepts of force, common fear and reverential fear in the light of the doctrine and jurisprudence of the Roman Rota. The third part analyses the essential elements of the justification of the Rota of Rome sentence mentioned in the title, in particular: the plaintiff’s credibility and her aversion to the defendant.
