Blask nadziei w mroku rozpadu małżeństwa. Hermeneutyka procesu o nieważność małżeństwa w świetle przemówień papieża Franciszka do Roty Rzymskiej

Abstract

One of the first comprehensive reforms of canon law undertaken by Pope Francis was the reform of the canonical process for the declaration of marriage nullity, introduced through the apostolic letter in the form of motu proprio Mitis Iudex Dominus Iesus. This was a clear sign that the issue held significant importance for the Bishop of Rome. His understanding of the reality of the marriage nullity process can be discerned not only from the provisions of the aforementioned document but also from the addresses he delivered to the judges and staff of the Roman Rota at the beginning of each judicial year.

This article offers a synthetic presentation – based on Pope Francis’s rotal allocutions – of the phenomenon of marital breakdown and the crisis of the family, including its causes and consequences. It presents the marriage nullity process as a pastoral activity of the Church directed toward those affected by family breakdown and includes guidance on the deontology of ecclesiastical legal professionals, especially judges, engaged in such cases. The procedure, as presented here, may be described as a „sign of hope” for those seeking to regularize their canonical status after the dissolution of their marriage.
