Commentary on the ruling of the Polish Supreme Court regarding so-called judicial reprimand and discontinuing the criminal proceedings due to lack of criminality of the committed act; the above-mentioned institution of judicial reprimand is regulated in Article 40 of the Act of 27 July 2001 – Law on the System of Ordinary Courts, while discontinuation of proceedings in Article 17(1)(2) of the Code of Criminal Procedure read in conjunction with Article 339(3)(1) of the Code; the Supreme Court correctly interpreted the provisions of the Polish law but did not refer in detail to the practice (law in action) of applying the above-mentioned legal institutions.
