
In Polish law as it currently stands, the form of a power of attorney depends on its type and the juridical act it is to authorize to perform. This regulation originates from the pre-war Code of Obligations. During the work on this act, the drafters unanimously believed that a power of attorney should be, in principle, allowed to have any form, but this notion was ultimately abandoned. Nowadays, in order to defend the formalised form of a power of attorney, one should take into account technological achievements whose use can improve the institution in question.
