Abstrakt

Posiadanie narkotyków, w tym NSP, stanowi wyzwanie prawne i społeczne w skali globalnej. Podczas gdy w krajach Zachodu obserwuje się często liberalizację prawa, w wielu państwach Azji i Bliskiego Wschodu utrzymują się regulacje restrykcyjne. Analiza polityki narkotykowej Turcji i Zjednoczonych Emiratów Arabskich (ZEA) uwidacznia kontrast między państwem świeckim a islamskim: Turcja stosuje kary proporcjonalne do rodzaju substancji i intencji sprawcy, wspierane mechanizmami monitorowania narkotyków i współpracy z EMCDDA (EUDA), natomiast w ZEA obowiązuje polityka zero-tolerancji, a handel narkotykami może skutkować karą śmierci. Artykuł podkreśla znaczenie uwarunkowań kulturowych, religijnych i prawnych w kształtowaniu polityki narkotykowej. Analiza opiera się na metodzie prawnoporównawczej, wybranych pozycjach z literatury i raportów międzynarodowych oraz uwzględnieniu kontekstu kulturowego i religijnego.
