
The article analyses the amendments introduced by the Act of 28 June 2024 Amending the Penal Code and Certain Other Acts. The revision of Articles 197 and 198 of the Penal Code was intended to implement the Istanbul Convention and clarify case law on rape by explicitly stating that any sexual intercourse occurring without the consent of the person subjected to the act constitutes rape. However, new provisions raise interpretative concerns, both from the perspective of the implementation of international law and the practical implications of the amendments for the practice of applying the law.
