Whether or not an expert opinion issued for different proceedings can be used in civil proceedings has been the subject of much discussion in literature and jurisprudence. To settle this matter once and for all, one of the draft amendments of the Civil Code proposes a new provision – Article 2781 of Polish Code of Civil Procedure – to provide direct legal basis to admit opinions commissioned by public authorities in different proceedings conducted under the authority of an act of Parliament. This will make it possible to speed up the course and limit the costs of civil proceedings, and, thanks to prescribing some limitations relating to the basis for ordering such evidence (proceedings provided for by an act of Parliament) and the ordering body (a public authority), it will also guarantee that the principle of fair trial (due process) is upheld in relation to the expert’s impartiality.
