Abstract

In the Swiss Confederation, whose national heritage includes federalism, direct democracy, and wide cantonal autonomy, there are six dioceses and two territorial abbeys. In three dioceses (Basel, St. Gallen, and Chur), the provision of the episcopal office is dependent, meaning it is made through the election of the cathedral chapter, granted by concordat or papal privilege. Because the right to appoint bishops is a special, exclusive, and inherently exclusive right belonging to the Bishop of Rome, these elections require papal confirmation, which is obtained after an informational process regarding the candidate. In the remaining dioceses, despite the Pope’s free conferral, there are clauses regarding the future bishop. The procedures for appointing bishops in Switzerland, considering contemporary political and theological principles, such as the autonomy and independence of the Church in its relations with the state and the principle of synodality in the Church, appear insufficient and inadequate in the context of the ecclesiology of the Second Vatican Council. Cathedral chapters have lost their jurisdictional significance. They have been replaced by synodal bodies, such as the Presbyteral Council of Priests and the Pastoral Council, which, to a broader extent, represent the People of God in a given diocese. This article proposes, in accordance with the canonists’ demands and the recommendations of the 2024 Synod on Synodality, that the process of electing a bishop should be more closely involved within the structures of the entire diocese, and, in accordance with ancient practice, also within the ecclesiastical provinces, so that, through synodal consultation, decisions made more closely reflect the reality of the particular Church.
