The commented Supreme Court judgment of 31 May 2023, II CSKP 281/22, addresses, among other things, the issue of the form of confirmation of a juridical act performed by an unauthorised agent (falsus procurator). The judgment assumes that no provision of the Civil Code requires a specific form for this act, so a declaration of intent confirming a so-called limping transaction may be made in any form. Furthermore, it states - which is unacceptable in the commentator's opinion - that in principle this is the case, an exception to which principle may result from Article 99(1) of the Civil Code.
