The Polish civil procedure provides for two methods of initiating arbitration proceedings – by filing a request for arbitration or a statement of claim. The introduction, at the beginning of this year, of new regulations in two leading Polish arbitration institutions provides a stimulus to compare both mechanisms, as well as to indicate and discuss the possible theoretical and practical dilemmas in their application.
