New extrajudicial divorce procedure in Polish family law in the light of Japanese family law

Abstract

This article addresses the concept of extrajudicial divorce, drawing on the proposal in the bill to amend the Family and Guardianship Code, developed by the Codification Commission. Based on this initiative, the author examines the possibility of introducing a solution similar to the Japanese model of divorce, which allows for extrajudicial dissolution of marriage in specific situations. The article discusses the current provisions of the Polish Family and Guardianship Code and analyses the proposed amendment, which is aimed at simplifying divorce proceedings. The author compares the Polish divorce system with the Japanese one, highlighting differences in procedures and the potential benefits of implementing a similar solution in the Polish system of family law. The article also reflects on the potential social and legal consequences of introducing extrajudicial divorce.
