
For Polish citizens, the war in Ukraine that has been going on for three years, in addition to its humanitarian and military dimensions, also has a legal dimension. This applies mainly to those citizens who, from the first days of the Russian aggression, came to help the Ukrainian fight by joining its armed forces. And while from a moral point of view such an attitude deserves recognition and respect, from a legal point of view it may result in criminal liability. The problem is whether volunteers who went to serve in a foreign army or a foreign military organization obtained consent from the Polish authorities to do so. Lack of such consent, in accordance with applicable law, constitutes an offence described in Article 141(1) of the Penal Code. The article discusses the legal aspect of the regulation in question and expresses a negative opinion on the lack of appropriate legislative actions in
this area, in particular through the incomprehensible postponing of the adoption of the abolition act.
