The article is an approach to the problem of religious freedom of doctors in Poland and whether such a problem exists in practice at all. An important reference will also be the judgment of the Constitutional Tribunal of 7 October 2015, ref. no. K 12/14. Considerations will concern the religious freedom of doctors refusing to perform abortions and the effectiveness of any claims arising from refusals to perform abortions, as well as the very disturbing phenomenon of gender reassignment, especially when it concerns minors. This means the emergence of another field for the exploitation of the conscience clause by medicals, but in the sphere determined by scientific views and the so-called evidence-based medicine.
