Origin of Principle of Cooperation between the Catholic Church and the State in the Projects of the Constitution of the Polish Republic of 1997

Abstract

The subject of the article is analysis of the uprising and evolutions principle of cooperation in particular constitution projects until to the final formulation in art. 25 par. 3 currently valid basic law in Poland. For shape of this principle, characteristic are stages of work on the entire Constitution, namely years 1989-1991, 1992-1993 and 1993-1997. Rationale of this is located in political events in Poland and change legislative process. Among all reported projects only in one case submitted by Polish Confederation of Independent and Center Aliance was not reference to principle of cooperation. The proper functioning of this principle is not possible without guarantee of respect others principles of mutual Church-State relations. Therefore, as a consequence, the principle of cooperation is justified only in normative context with principles of religious freedom, respect for the autonomy and independency of Church and State, and also forms of regulation of relations between them.
