
The issue of the doctor’s obligation to provide information and the related patient’s consent to a surgical procedure, despite numerous studies on the subject, is still relevant and requires in-depth analysis, especially in the context of pending court disputes. This particularly concerns the issue of violating the patient’s right to full information about high-risk procedures. This study will present a theoretical and legal analysis of two fundamental aspects important from the perspective of the doctor and the patient in the light of the views of the doctrine and court decisions. Firstly, the doctor’s information obligation towards the patient and the related order to collect informed consent to a high-risk surgical procedure in an appropriate form and content, and secondly, respecting the patient's right to information in practice. The analysis of the described issues is limited exclusively to patients who are of legal age and have full rights to perform legal acts.
