The act amending the Code of Civil Procedure has introduced a provision on a temporary derogation (episodic provision) regulating exclusive jurisdiction of courts in cases relating to claims arising from so called “franc” loans, if the claimant is a consumer. This jurisdiction has been tied to the place of residence of the claimant. The subject of this paper is an attempt to answer the question of how the territorial jurisdiction of the court should be determined in a case in which the claimant is a consumer, but does not have their place of residence in Poland.
