On 15 June 2023, the Court of Justice delivered its judgment in case C-287/22, YQ i RJ v. Getin Noble Bank S.A. The deliberation in the judgment focuses on the issue of preventive measures in cases involving Swiss franc loan agreements. Although EU Member States are free to determine the procedures for pursuing such claims, the relevant procedural provisions should respect the principle of effectiveness. Suspension of the payment of the monthly loan instalments for the duration of the proceedings in a case in which declaration of invalidity of the loan agreement is sought constitute an implementation of this principle.
