Prosecution and penalization of child sexual abuse offences as a limitation of the priest- penitent privilege

Abstract

In numerous documents, the international community decided to grant children special protection of their rights. It becomes particularly important in the context of protecting children from sexual abuse. To this aim, some states decided to introduce exceptions to the priest-penitent privilege. This article focuses on these exceptions and analyses the colliding rights, namely the children’s rights and the right to freedom of conscience and religion. Moreover, it examines whether such an exception should be introduced in Poland and subject to what conditions.
