The article presents the current state of work on individual statutes, the enactment of which is sought by non-Christian religious associations under Article 25(5) of the Constitution. Since the entry into force of the Constitution, 11 non-Christian religious associations have applied for an individual law: the Buddhist Association of the Diamond Way of the Karma Kagyu Line in the Republic of Poland, eight Buddhist religious associations associated in the Polish Buddhist Union, the Islamic Assembly of Ahl-ul-Bayt and the Native Faith. The article analyzes documents from the archives of the Department of Religious Denominations and National and Ethnic Minorities – Ministry of the Interior and Administration, including applications submitted by religious associations and responses provided by the government, as of April 30, 2025. Regardless of their political affiliation, successive governments do not take any real steps to conclude agreements with religious associations, which leads to the conclusion that Article 25(5) of the Constitution remains a dead provision and does not fulfil its function. It seems necessary to amend the Constitution with regard to clarifying the criteria that must be met by religious organisations in order to be able to apply for the enactment of an individual statute under Article 25(5) of the Constitution.
