This study examines the issue of deepfake technology, with particular emphasis on its mechanisms, applications, and the potential threats it poses in various areas of social life. It outlines the elements of prohibited acts that may be committed by individuals who create or distribute deepfake content. The aim of the article is to analyse the deepfake phenomenon in the context of selected provisions of the Polish Penal Code, as well as in light of the relevant provisions of German criminal law. In addition, the article discusses the provisions contained in the Artificial Intelligence Act, which establish a system of protection against the malicious use of deepfake technology based on transparency obligations. The study provides an assessment of the applicable provisions of Polish and German criminal law with regard to the protection of persons who may be harmed by the dissemination of deepfake content, and also evaluates the regulatory framework adopted at the EU level.
