Among the many manifestations of commune’s activity as a public-law corporation there is also running an economic activity, where it features as an entrepreneur. Various needs of residents are satisfied through services provided in this way. However, the specificity of regulations protecting tenants’ rights imposes a reflection on whether also in the area of housing (including renting residential premises) we are dealing with economic activity. Particular attention is also paid by regulations on competition and consumer protection, in which the commune is treated as an entrepreneur also where it organizes or provides services of a public utility nature, which do not classify as economic activity.
