The President of the Office of Competition and Consumer Protection is the central body for the governmental authorities competent for competition and consumer protection. The President performs his duties and obligations basically by way of administrative decisions. Judicial control over decisions issued by the President of the Office is unique because it is different from typical judicial control over operations of bodies of public administration in Poland. Notably, judicial control is not performed by an administrative court but by a common court of law, the District Court of Warsaw, the Competition and Consumer Protection Court. The Court proceeds in accordance with the regulations of the Code of Civil Procedure (proceedings in cases regarding competition protection under Article 47928–47935 of CCP). The subject matter of judicial control does not cover all the actions performed by the President of the Office to the extent of any known and acceptable legal forms of administrative procedure but it focuses exclusively on decisions and some resolutions. Proceedings conducted before the Court are similar to those of a court of the first instance and have an adversarial approach. In the course of proceedings, the Court is obliged to hear evidence and clarify the case comprehensively. During the review of decisions issued by the President of the Office by virtue of the Act on Competition and Consumer Protection, the Competition and Consumer Protection Court does not only audit accuracy and correctness of proceedings run before the President of the Office, and the Court’s judgment is not a cassation. Such judgements may be appealed to the Court of Appeal in Warsaw. Judgments of the Court of Appeal may be cassated by the Supreme Court.
