Searches of advocates’ premises under the Polish law in light of the latest case law of the European Court of Human Rights

Abstract

In 2025, the European Court of Human Rights delivered two key rulings regarding the protection of legal professional privilege during searches of advocates' premises. In these rulings, the ECtHR emphasised the role that professional self-government representatives should play during searches. Their participation should not be merely formal and they should have the authority to effectively protect the legal professional privilege. The Polish law, which unfortunately does not meet the convention standard, is subsequently analysed from this perspective.
