Postulat de lege ferenda w zakresie przestępstwa obcowania płciowego z małoletnim

Abstrakt

The article concerns the legislation relating to the offence of sexual intercourse with a minor under Article 200(1) of the Penal Code. In this respect, the current legislation is found to be somewhat incomplete, the gap is identified and a solution suggested. It consists in amending Article 200 of the Penal Code by adding paragraph 2, which would describe this offence under a quasi-mitigated form as an act of lesser gravity. The present proposal is an assessment of the current state of the law by explaining why a change in legislation in this respect is needed.
