A Physician’s Liability for Wrongful Birth in the Polish Law

Abstract

The article selectively deals with issues concerning a physician’s compensative liability for wrongful birth in the Polish law. It considers mainly the grounds for claims made by parents of handicapped children and the nature of a legal interest subject to violation. The article also presents the current state of the Polish legal doctrine and judicature. lt also analyses the premises for validity of awarding damages or compensation. The Author is of the opinion that lawsuits brought on account of wrong death are inadmissible in the Polish law, and she points out the lack of adequate systemic solutions that would put a norm on a physician’s liability regarding conception and birth.
