Infection of a Patient in a Dental Practice – a Legal Liability of the Medical Facility and the Doctor During the SARS-CoV-2 Pandemic

Abstract

There is frequently information given that patients apply for financial compensation mainly related to infection that occurred, in their opinion, in a specific medical health service as a consequence of specific treatment performed by particular dentist. It needs to be highlighted that both the dentist and the medical facility are not on a lost position from the beginning. Dentists should be up-to-date with legal rules and medical/sanitary regime/scientific societies recommendations concerning functioning of a medical facility during the SARS-CoV-2 pandemic, as well as legal and insurance security of a medical facility, and above all a dentist one, should be the basis for safe treatment service. The article analyzes a legal position, scientific societies and national consultants recommendations respectively regarding therapeutic activities by dentists in the SARS-CoV-2 pandemic.
