This study addresses issues related to the genesis and evolution of criminal law regulations for the protection of state symbols, and the current legal status in this area. The starting point is the Act of August 1, 1919 on the emblem and colours of the Republic of Poland. Furthermore, all subsequent Polish legal acts have been analyzed, in which the relevant regulations of criminal law have been included, taking into account constitutional and administrative law regulations. The culmination of the work are the final conclusions that systematize the discussed issues, reveal flaws in the current design of legal norms and the interpretation doubts arising from them.
