As provided by the current legislation of the Catholic Church, appeals of defective administrative acts include the extra-hierarchical and hierarchical types. The parties to a contentious-administrative recourse are: the congregation of the Roman Curia (a body of the executive authority) as the sued party, and a particular physical or legal person with legal capacity who is filing the recourse. The suing party has a unique entitlement to appear as a subject filing a particular recourse. The object of the recourse to the second section of the Apostolic Signatura is an administrative act issued by a competent dicastery of the Roman Curia. The legislator provides that only illegitimacy of an administrative act may constitute a motive for a contentious-administrative recourse, that is a violation of a law in procedendo vel in decernendo.
