It is the Supreme Court’s competence to state that the elections in Poland are valid. The Constitution of the Republic of Poland and the Electoral Code provide for the possibility of lodging a protest to this Court against the validity of the election. An election protest is a specific legal measure used by voters to report violations of the voting code provisions, determining voting results or election results, affecting the election result. This measure should be used in the public interest. However, a significant part of the lodged protests does not meet the necessary formal conditions. At the same time, the allegations contained in them very often refer to the information activity of the mass media during the election campaign. This phenomenon was analyzed in the gloss and an attempt was made to answer the question of what could be its cause. It shows the issues of media activity during the election campaign in the context of the legal limits of bringing election protests. It also discusses the jurisprudence of the Supreme Court in this regard.
