Abandonware—New Challenge for Copyright Law

Abstrakt

Abandonware primarily refers to classic computer games that, despite the lack of legal distribution, remain protected by copyright. This phenomenon highlights the tension between the rights of copyright holders and the public interest in preserving digital
cultural heritage. The regulations in force in the European Union concerning orphan works and works that are no longer commercially available cover computer games only to a limited extent. The issue of abandonware also has literary and cultural dimensions. Games are complex cultural texts that combine narrative, imagery, sound, and interactivity, and are also the subject of research on digital narrative, intermediality, reception, and cultural memory. The loss of access to older games thus limits not only access to the software itself but also the ability to study historical forms of narrative and the development of interactive media.
