The right to a court is a key guarantee of the protection of civil and political rights and freedoms. The effectiveness of this right depends on the full implementation of the principle of judicial impartiality and the independence of judges. Between 2015 and 2023, attempts were made to seriously violate these principles. The Constitutional Tribunal of Poland has lost credibility. Do the courts still fulfil their guarantee role and to what extent, and can they be an alternative to the Constitutional Tribunal?
