In this article, the author referred to the differentiation of the protection of property rights belonging to the owner or perpetual usufructuary of real estate when determining the amount of compensation for a decrease in the value of real estate due to with
the entry into force of the local spatial development plan or its amendments. The understanding of the constitutional principle of equal protection of property rights and the institution of the above-mentioned compensation resulting from the law and jurispru-
dence. Particular emphasis was placed on the amendment to the Act of 27 March 2003 on spatial planning and development (i.e. Journal of Laws of 2022, item 503), which entered into force on 7 January 2023, i.e. added to Art. 87 of this Act sec. 3b relating to the selected type of historical local spatial development plan.
