The subject of this article are considerations on the advisability and de facto legality of the resolution adopted by the Polish government in January 2025, which called into question Poland’s respect for the international legal order. Importantly, the resolution in question also disregarded the Polish legal order, which is surprising because, in accordance with the constitutional principle of legalism, public authorities are particularly obliged to act on the basis of the law and in accordance with the law. The author expresses disapproval of this measure, arguing that the Polish state, as a sovereign party to an international agreement, is obliged to comply with its contents, regardless of the political conditions.
