The aim of this paper is to show the constitutional and statutory provisions about the limitations of the freedom to publicly express religion according to Constitution of Poland of April 2nd, 1997. The conducted analysis shows that a limitation of this freedom in extraordinary measures: martial law, a state of emergency or a state of natural disaster is generally forbidden. This conclusion is confirmed in the regulations of a state of emergency, introduced on September 2nd, 2021 in some towns of Podlaskie and Lubelskie Voivodships at the Polish-Belarusian border. However, a limitation of the freedom to publicly express religion is possible in compliance with the requirements set out in art. 31 par. 3 and art. 53 par. 5 of Polish Constitution. Therefore there was possible to limit of this freedom in connection with declaration the state of epidemic due to COVID-19 pandemic, but these limitations was introduced with violation of aforementioned constitutional principles. In final proposals of this paper there are some suggestions to introduce some necessary legal changes in order to avoid doubts as to the compatibility of these limitations with the Constitution of Poland.
