The view taken by the Supreme Court challenging the resolution of the National Electoral Commission imposing on it the obligation to accept the notification on the formation of the Election Committee of the Candidate for the President of the Republic of Poland Sławomir Grzywa does not deserve approval. The National Electoral Commission correctly applied the provisions of the Election Code by setting a deadline of three days for the submission of one thousand signatures of support due to the fact that initially the signatures were provided on sheets containing an annotation contrary to the requirement of the Act. The fact that there was coronavirus outbreak across the country during the period when the obligation to provide signatures existed could not be taken into account. The provisions of the Election Code do not specify how election activities should be carried out during the period of epidemic emergency, and the only possibility of suspending election procedures would then be the introduction of a state of emergency, which, however, was not declared.
