The subject of considerations in this article is limitation of the possessor’s claims for reimbursement of expenditures made during the period of possession. Due to the fact that the provisions of the Civil Code in Art. 229 provide for one general limitation period for supplementary claims of the owner and for claims of the possessor for reimbursement of expenditures, the issue of emergence and maturity of particular claims referred to in this provision causes discrepancies in both doctrine and jurisprudence. In particular, this refers to the possessor’s claims for reimbursement of expenditures made on a thing. Against the background of considerations regarding the maturity and limitation of supplementary claims, the article discusses the issues of limiting the possessor’s claim for reimbursement of expenditures by general limitation periods based on Art. 118 of the Civil Code.
