On January 22, 2020, the Speaker of the Parliament addressed the Constitutional Tribunal, asking to investigate the competence conflict: the Supreme Court versus the President of Poland and the Polish Parliament (Act signature – Kpt 1/20). This is strictly a competence conflict of positive character, although not understood in a classical way. The crucial issue is the attempt of the Supreme Court to enter the area of competence reserved for the legislative body, specifically for the Polish Parliament which is meant to define the political system, jurisdiction and procedures before courts. The issue also concerns the President’s prerogatives to appoint judges recommended by the National Council of the Judiciary. The judgement passed by the Constitutional Tribunal will be of momentous importance.
