Motives of Hierarchical Recourse to the Congregation of the Roman Curia

Abstract

This article discusses the motives of hierarchical recourse to the Congregation of the Roman Curia. The legislation provides that hierarchical recourse can be filed for any good reason. Any defect of an administrative act pertaining to the circumstances under which this act was issued by an executive Church authority may constitute a reasonable motive and shall be applied. Therefore two motives are distinguished: 1) formal (causa petendi) and subjective (petitum). The person who files a recourse should indicate an objective legal norm which they think has been breached by the administrative act. The very institution of hierarchical recourse serves to protect the rights of the faithful and the observance of administrative justice.
