Abstract
The author’s primary focus in this study was the impact of burnout syndrome on consensual incapacity to marry. He pointed out that this topic had not been addressed in canon law literature to date. In his research, a search of the Roman Rota’s case law yielded no satisfactory results, as no case involving burnout syndrome was conducted in that tribunal. However, the author noted that the term „burnout”, associated with the prospective spouse’s depression, appeared in several rulings. This factor, along with workaholism, raised in psychological and medical literature, provided the basis for his intended topic, as issues in this area were addressed by canonists. The main research goal of this study was to apply the achievements of psychology and medical science to canon law, based on the principle of „methodological purity”. Using an analytical and dogmatic-legal approach, the author leans toward the thesis that cases involving burnout syndrome, depending on the circumstances, should be pursued under one of the grounds specified in Canon 1095, 2°-3°: grave lack of discretion of judgment or incapacity to assume the essential obligations of marriage.
