Right of the Faithful to Fast and Efficient Ecclesiastical Tribunals

Abstract

In the Code of Canon Law of 1983, the right of the faithful to fast and efficient ecclesiastical tribunals was not guaranteed. The Pope Benedict XVI pointed out such an authorization in his allocution to the members of the Supreme Tribunal of the Apostolic Signatura, on the 4th February 2011. The direct reason for making this law by the Roman Pontiff were constant cases tried by some ecclesiastical tribunals. This situation is against with the principle of legality and justice, which applies in the Church. Therefore, in the Church, there are: 1) the right of the faithful to the legal investigation and protection of their rights, 2) the obligation on fast and efficient operation of tribunals and 3) the obligations of jurisprudence for the strengthening of ecclesiastical communio.
