This article addresses the interpretation of the concepts mentioned in its title, namely, the “legal status of real property” and the “intended use (function) of real property.” Given that the legal status of real property falls under the broader concept of the status of real property, the article also presents an understanding of that term. Furthermore, the issue of the “actual legal status of real estate” is discussed, presenting for this purpose a model for reconciling the legal status disclosed in the land and mortgage register with the actual status. The interpretation of the above concepts is based on legal provisions,
relevant literature, and case law—including divergent case law. The text was prepared using a dogmatic-legal approach.
