The seizure of agricultural real estate into the ownership of the State for outstanding debts was regulated by the Act of 28 June 1962 on the seizure of agricultural real estate into the ownership of the State for outstanding debts. Despite the repeal of the above-mentioned Act, the legal issue arose as to whether, in the face of real estate taken over under the provisions of the said Act, it is possible to recover it. This issue is all the more topical because, over the years, the institution of return of expropriated real es-
tate, which is now regulated by the Act of 21 August 1997 on real estate management, has been functioning in Polish real estate law. The issues of taking over agricultural real estate for outstanding debts, return of expropriated real estate and mutual relations of these legal institutions have also become the subject of consideration of the jurisprudence and the doctrine of law. It should be concluded that the institution of restitution of expropriated real estate will not be applicable to agricultural real estate taken over for outstanding debts under the said 1962 Act.
