The subject of this article is the authority recognizing and enforcing the European Production Order for the surrender of electronic evidence in the context of the principle of mutual recognition of judicial decisions. The judicial authority is defined in the light of European legal standards. The relationship between the authority recognizing and executing the European Production Order for the surrender of electronic evidence – which is the legal representative of the service provider – and the judicial authority has
been analyzed. The analyzes presented are key to verifying that the legal representative of the service provider has been established in accordance with the principle of mutual recognition of judicial decisions. A desirable legislative direction is indicated – from the perspective of protecting the rights of the suspect and the accused.
