Right to Defense in the Canonical Penal-Administrative Process. An Outline

Abstract

The legislator in the 1983 Code of Canon Law states that the Christian faithful – both the lay Christian faithful and the clerics – can legitimately vindicate and defend the rights which they possess in the Church in the competent ecclesiastical forum according to the norm of law (can. 221 § 1). The competent ecclesiastical forum considers not only the judicial process but also the extrajudicial (administrative) one.
