Non-competitive elections are the procedure for selecting the candidates for legislative bodies, when the number of the candidates is less or equal to the number of the seats. Then the elections are not held and the candidates receive the seats. In the German legal language this procedurę has a name “Friedenswahl.” It is popular in the elections in the insurance companies, especially in the health insurance. The popularity of this procedure is criticized in the literature, because it threatens the legitimacy of the insurance institutions. It is related to low voter turnout rate, list voting system, monopolisation of elections by employer organisations and trade unions. Tacit elections are accepted in the judiciary, as constitutional.
