A draft of a new Polish Private International Law was accepted in 2005 and modified in 2006 within the framework of Commission on Civil Law Codification. The main objective of the article is to indicate to which extent the draft is based on the tradition (1926 and 1965 Private International Law) and to which extent is based on innovative regulations. This draft introduces far-reaching changes, such as mandatory rules or extension of the scope of freedom of the parties' will, in comparison with 1965 Private International Law currently in force. However many deeprooted to Polish science of private international law institutions were preserved, for example determination of applicable law on the grounds of nationality. Thus the necessary balance between the progress and the tradition was kept.
