Organized activity of paedophile hunters gives rises to many legal doubts, related to the assessment of the behaviour of persons “caught” as a result of a trap set by hunters. The study indicates that a person trying to meet with an adult hunter, mistakenly believing that they are dealing with a child under the age of 15, does not fulfill the features of a penalized act. According to the extensive analyses presented in the Polish literature, the Polish Criminal Code does not provide for criminal liability for ineffective preparation for a crime, and does not provide grounds for using the concept of “attempted grooming”. Therefore, it is impossible to agree with the views expressed by Radosław Krajewski in the article titled “Criminal law doubts about the activity of pedophile hunters” published in Palestra 2022, vol. 7–8 These views are discussed in detail in the present study.
